Věc: Výpověď z pracovního poměru
Vážení,
u Vaší společnosti jsem zaměstnán jako Projektový manager na základě pracovní smlouvy ze dne 1. 3. 2005.
Tímto v souladu s § 50 Zákoníku práce dávám výpověď z výše uvedeného pracovního poměru.
Pracovní poměr tak skončí uplynutím dvouměsíční výpovědní doby.

Poznámky ke vzoru:
Výpověď musí být dána písemně a doručena druhému účastníku, jinak je neplatná. (§ 50 Zákoníku práce). Proto je vždy dobré nechat si potvrdit doručení výpovědi přímo na vaši kopii, aby následně doručení a tím i platnost výpovědi nemohla být zpochybňována.
Zaměstnanec může dát zaměstnavateli výpověď z jakéhokoli důvodu nebo bez uvedení důvodu.
POZOR! Výpověď, která byla doručena druhému účastníku, může být odvolána pouze s jeho souhlasem; odvolání výpovědi i souhlas s jejím odvoláním musí být provedeno písemně. (§ 50 Zákoníku práce 262/2006 Sb.)
Výpovědní doba činí 2 měsíce a začíná prvním dnem měsíce následujícího po doručení výpovědi. Výpovědní doba začíná prvním dnem kalendářního měsíce následujícího po doručení výpovědi a končí uplynutím posledního dne příslušného kalendářního měsíce.

dobrý den, mám problém se svým zaměstnavatelem podala jsem výpověď, ale můj zaměstnavatel jí nechce akceptovat a nepřímou cestou se mi snaží naznačit, že na mě může podat žalobu k soudu na náhradu škody, ale kvůli mé výpovědi se v práci nic nemění. Jsem ochotná odejít i na §53, ale i tak hrozí žalobou. Co mám teď dělat? Jak se mám bránit?

Dobrý den,ráda bych věděla,co mám dělat.Vedoucí mi slíbila odejít dohodou,ale v určeném termínu mi řekla,že nic nedostanu a mám přijít po neděli opět do práce.Takové jednání se mi nelíbí,co se může stát,když nepřijdu do práce?Vedoucí(majitelce) už nevěřím,a nechci se vrátit na její provozovnu,právě z důvodu neprofesního jednání.děkuji moc za radu

Dobrý den,
uvedený vzor výpovědi je zastaralý, § 50 je v zákoníku práce zrušen. Buď sled tohoto vzoru změňte, nebo vytvořte vzor nový, od kterého se budou moci zaměstnanci odrazit a výpověď podat co nejpřesnější.
Při podání takto upravené výpovědi s tímto odkazem na §50 může zaměstnavatel lehce do zákoníku práce nakouknout a tímto se vysmát člověku, který výpověď podává.

zaměstnavatel je povinnen vaši výpověď přijmout, jak s uvedením nějakého důvodu, tak bez uvedení nějakého důvodu. V opačném případě bych se obrátil na úřad práce, který provede kontrolu, popř. zjedná nápravu.

Pro pana Daniela, bohužel se mýlíte, protože výpověď je upravena v novém zákoníku práce 262/2006 Sb. skutečně v § 50. Proto by se člověku opravdu zaměstnavatel vysmát neměl.

dobrý den, mám problém se svoji zaměstnavatelkou. V nynější práci nejsou stále pracovní zakázky a pracuji za minimální plat. Dostal jsem nabídku na lepší pracovní post s lepsím finančním ohodnocením. Když jsem poprosil zaměstnavatelku o ukončení pracovního poměru dohodou stále se mi vyhýbá a nechce to řešit, nebo slyším zvěsti od vedoucích o tom, že budu mít problémy když odejdu v klasickém pracovním poměru, např. bych jí musel vynahradit ušlý dvouměsíční zisk. Nevyznám se v zákonech a nevím jak takovou situaci řešit a chtěl bych vědět jestli je to pravda. Problém je i v tom, že zamětnavatel, ke kterému bych chtěl jít pravděpodobně dva měsíce nepočká.

Dobrý den,chtěla jsem rozvázat pracovní poměr dohodou bez 2měsíční výpovědní lhůty v pracovní neschopnosti a jela jsem na firmu se dohodnout.Nejdřív mě tvrdily,že to nejde,pak,že není přítomna kompetentní osoba pak tedy jsme vytvořily návrh na rozvázání dohodou a že to nechají podepsat nadřízené.Tak jsem stejně zaslala mojí výpověd dohodou a návrh,který vytvořila asistentka doporučeně poštou, abych dodržela výpověd do konce měsíce.Múžete mě poradit co mám očekávat a jestly jsem udělala dobře.

dobry den, chtela jsem se zeptat je mozny dat hodinovou vypoved i kdyz mam ve smlouve napsano dvou mesicni vypovedni lhutu. je to z důvodu malo placena prace a neschody v praci. moc vam dekuji za odpoved diky

Syn je zdravotně postižený-epilepsie a je mu přiznán plný invalidní důchod.Je absolventem bakalářského studia -charitativní a sociální pomoc.Po ukončení stjudia nastoupil jako zaměstnanec k firmě “Život bez bariér o.s. do Nové Paky.Po dvouleté pracovní činnostidostal k 1.10.2008pracovní výpověď s dohodou.Dle zákoníku práce §49 zákona č.262/2006 Sb .§ 50 téhož zákona nedovoluje podat výpověˇpracovníkovi zdravotně postriženému bez souhlasu pracovního ůřadu. Prosím o informaci ,zda máme nárok na odvolání

Dobrý den, podepsala jsem před dvěma týdny smlouvu o výkonu činnosti vázaného zástupce se společnosí, která obchoduje na kapitálovém trhu. Domnívala, jsem se, že podepisuji běžnou pracovní smlouvu, nebrala jsem celou záležitost vážně. Nyní už vím, že situace je poněkud komplikovanější. Firma, ve které jsem zaměstnaná, má velice pochybnou pověst. Ráda bych s ní tuto smlouvu co nejdříve přerušila, ale nevím, co vše mě může potkat. Už prý je poslana do ČNB žádost o moji registracií jako vázaného zástupce.Dle smlouvy bez tohoto povolení od ČNB nemohu činnost, stanovenou ve smlouvě, vykonávat. Výpovědní lhůta je jeden měsíc. Mohu dát výpověď dohodou anebo okamžitě (v případě že přestanu splnovat podmínky výkonu činnosti podle § 14 odst.2 ZPKT a § 32b ZPKT). Jakým způsobem dát v tomto případě výpověď?

Dobrý den,mám prosbu.V srpnu jsem rozvázala pracovní poměr dohodou,protože jsem měla pracovní úraz a nemůžu ze zdr. důvodů vykonávat dál svoji práci,jenže v dohodě jsem uvedla odchod ze zdra. důvodů.ale byla mi vrácena dohoda jiná, kde už tento důvod uveden nebyl,je tam uveden jen § 49.Já svojí nepozorností jsem to podepsala a tím se připravila o nárok na odstupné.Chci se zeptat jestli je nějaká možnost kdy by přece jen narok na odstupné byl,nebo je vše ztraceno.Děkuji Handlová

Dobrý den, chci ukončit prac. poměr z důvodu nízkého příjmu jakožto živitele rodiny. Navíc ve firmě kde pracuji panují šetřivá opatření a samozřejmě se to promitnulo i do mzdy.Prac. poměr chci ukončit dohodou do jednoho měsíce od doručení výpovědi zaměstnavateli.1, Musím dát výpověd na začátku měsíce nebo i z kraje měsíce např. 06.04.2009? 2, Je možné odejít po dohodě do jednoho měsíce nebo musím počkat na první den měsíce následujícího od doručení výpovědi. 3,Bojím se že další zaměstnavatel mě po dvouměsíční výpovědní lhůtě nevezme pokud by to dohodou nevyšlo. Dobrý den mám dotaz.K 31.8 mi končí pracovní smlouva která je jen na jeden rok potom se obnovuje.když mám v plánu k31.8 odejít musím podat žádost o rozvázání pracovního poměru nebo stačí zaměstnavateli zavolat,že novou smlouvu nechci a že 31.8 končím.Děkuji

Dobrý den,
mám stejný problém jako výše uvedený David. Dnes jsem přišla za zaměstnavatelem s dohodou a on na ní nepřistoupil. Řekl, že v žádném případě jí nepodepíše, že mu mám dát výpověd. Že prý když mu dám výpověd, tak potom není problém se na čemkoliv dohodnout. Ale na čem se chce pak domlouvat, když podepíšu dvouměsíční výpovědní lhůtu? Dostala jsem prac. nabídku, která se neodmítá a bojím se, že nemůžou čekat dva měsíce… Je nějaký způsob, jak na to??

dávám-li zaměstnavateli výpověď, je nutné uvádět, že prac. poměr skončí uplynutím dvouměsíční výpovědní doby? V ideálním případě bych jej totiž rád ukončil i dříve.
Také jsem zaznamenal diskuzi, platí-li stále § 50. Platí?

Dobrý den rád bych se zeptal jestli můžu dát okamžitou výpověd zaměstnavateli z důvodu jeho arogantního chování neustáliho ponižování. vyhrožuje mi že mě dá k soudu a nechá mě zaplatit ušlej zisk a nevyplatí mi výplatu a diety pracuji jako řidič kamionu. děkuji za odpověd.

mám problém v tom že už nechci zpátky do práce a dva měsíce tam zásadně nevydržím je tam moc dusno. když se nechám vyhodit za nepřítomnost dostanu potom zápočtový list? to jestly budu mít špatnej posudek to mne netrápí práci seženu to nemám strach.

dobrý den,mám dotaz zda mohu dát okamžitou výpověd z duvodu dojíždění, nebot nemám žádné spojení na raní směnu a z odpolední směny. Prosim o upřesnění jak lze podat z tohoto duvodu vypověd a zda je to možné. Také bych se ráda dozvěděla zda se muže dát výpověd z duvodu stěhováni a musili být na to doklad. Moc předem děkuji. Dobrý den,prosím touto cestou o radu,jak postupovat a co dělat?Můj manžel pracuje jako řidič kamionu.Do nové firmy nastoupil před čtyřmi měsíci.Na účet mu chodí vyměřený základní plat,ale diety mu do dnešního dne nevyplatili,i když odevzdal vše v čas a v pořádku.K dnešnímu dni mu firma dluží cca 70 tisíc korun.Omlouvají to,že přecházejí na nový počítačový systém (4 měsíce).Mohou mu vyplatit tzto peníze jinou cestou?Na těchto penězech jsme existenčně závislí a hrozí,že díky tomu příjdeme o střechu nad hlavou,neboť nemáme na splátku hypotéky.Když bude manžel chtít odejít,musí dodržet výpovědní lhůtu a dluh se navýší o další tisíce.Co v tomto případě dělat?
