(dále jen „Zhotovitel“)
(společně dále také „smluvní strany“)
tuto
smlouvu o vytvoření software
uzavřenou dle § 536 a násl. zákona č. 513/1964 Sb. v platném znění, obchodní zákoník.
1. PŘEDMĚT SMOUVY
1.1 Zhotovitel se zavazuje pro Objednatele vytvořit počítačový program pro vedení účetnictví (dále jen „Program“).
1.2 Program bude vytvořen v souladu s požadavky Objednatele, které jsou specifikovány v příloze č. 1 této smlouvy.
1.3 Program bude Objednateli předán jeho naistalováním do počítače, popř. počítačů Objednatele a včetně jeho předvedení Zhotoviteli do 30ti dnů ode dne podpisu smlouvy.
2. CENA ZA DÍLO
2.1 Objednatel a Zhotovitel se dohodli, že cena za Program činí 30 000 Kč (slovy: třicet tisíc korun českých).1)
3. ZÁVĚREČNÁ USTANOVENÍ
3.1 Tato smlouva, jakož i práva a povinnosti vzniklé na základě této smlouvy nebo v souvislosti s ní, se řídí zákonem č. 513/1964 Sb., obchodní zákoník, ve znění pozdějších předpisů a souvisejícími předpisy.

1) Cena musí být ve smlouvě dohodnuta nebo v ní musí být alespoň stanoven způsob jejího určení, ledaže z jednání o uzavření smlouvy vyplývá vůle stran uzavřít smlouvu i bez tohoto určení.

..nechybi tady takove veci, jako datum zaplaceni honorare a vyse penale, naskakujici po nedodrezni terminu odevzdani, nebo platby ?

Především a hlavně zde chybí ustanovení o autorských právech k software a licenci - tyhle tři odstavce vydávat za vzor je diletanství hraničící s drzostí.
