I.
Žalobce uzavřel dne 1.1. 2005 s žalovaným v jeho provozovně v Třebíči v souladu s ustanovením § 601 a násl. zákona č. 513/1991 Sb., obchodní zákoník, ve znění pozdějších přepisů, zasílatelskou smlouvu, podle níž se žalovaný zavázal obstarat přepravu květin, zahrádkářských potřeb a keramického zboží z Třebíče do Liberce. Součástí smlouvy byl závazek žalovaného předmětné zboží při přepravě, která měla být provedena prostřednictvím Českých drah, a.s., řádně naložit a zajistit, v místě určení vyložit a dopravit do provozovny žalobce v Liberci, Hálkova 1.

Důkaz: zasílatelská smlouva z 1. 1. 2005 (příloha 1)

II.
Zboží, uložené ve 78 přepravkách, žalovaný v souladu se smlouvou převzal dne 3. 1. 2005. Jak z následné korespondence vyplynulo, zboží podal žalovaný k přepravě po železnici dne 14. 1. 2005 v žel. stanici Turnov. Zásilku převzal v místě určení, v provozovně žalobce v Liberci, Hálkova 1, dne 17. 1. 2005 zaměstnanec žalobce, pan Alois Vopička, bytem Stodolní 87, Praha 4 Háje od žalovaného, přičemž bylo při kontrole zjištěno, že chybí 17 přepravek se zahradnickými potřebami, o čemž byl sepsán protokol o předání zboží.

Důkaz: doklad o převzetí z 17.1. 2005, potvrzený žalovaným (příloha 2)

III.
Dopisem ze dne 19. 1. 2005, k němuž byl připojen zápis z předchozího dne (příloha 3), žalobce upozornil žalovaného na nesplnění závazku ze zasilatelské smlouvy a požádal ho o urychlené splnění smlouvy a doručení zbývajících 17 přepravek se zbožím. Žalovaný obratem sdělil, že přešetří okolnosti ztráty části zásilky, event. provede reklamaci u dopravce, a to dopisem z 23. 1. 2005.

IV.
Vzhledem k tomu, že na další urgenci žalovaný nereagoval, dopisem z 11. 2. 2005 žalobce požadoval na náhradu vzniklé škody v částce 23.435,- Kč. Žalovaný však odmítl škodu hradit s tím, že věc nebyla dosud dopravcem vyřízena. Dle ustanovení § 603 odst. 2 obchodního zákoníku zasílatel odpovídá za škodu na převzaté zásilce vzniklou při obstarávání přepravy.

Důkaz: dopis z 11. 2. 2005 se specifikací škody (příloha 6)
sdělení žalovaného z 22. 2. 2005 (příloha 7)

V.
S ohledem na výše uvedené žalobce žádá nadepsaný soud, aby vydal tento

r o z s u d e k :1)
„Žalovaný je povinen zaplatit žalobci 23.435,- Kč a uhradit mu náklady řízení, to
vše do 3 dnů od právní moci rozsudku.“

1)Příklad žaloby vychází z úpravy odpovědnosti zasílatele za škodu (§ 603 odst. 2
obch. zák.) vzniklou příkazci v rámci plnění závazků ze zasílatelské smlouvy (§ 601
a násl. obch. zákoníku), přičemž je třeba ještě doplnit, že za případné škody na věcech,
které zasílatel převzal a má u sebe, odpovídá ve smyslu ust. § 526 obch. zákoníku
jako opatrovatel ze smlouvy o uložení věci. V případě, že zasílatel realizuje
sám přepravu zásilky (§ 605), odpovídá za škody vzniklé přitom na zásilce jako
dopravce podle § 622 a § 624 obch. zákoníku.
