smlouvu o směně bytu za dům
uzavřenou dle § 611 zákona č. 40/1964 Sb. v platném znění, občanský zákoník, a § 6 a násl. zákona č. 72/1994 Sb., kterým se upravují některé spoluvlastnické vztahy k budovám a některé vlastnické vztahy k bytům a nebytovým prostorům a doplňují některé zákony (zákon o vlastnictví bytů), v platném znění
1. ÚVODNÍ PROHLÁŠENÍ
1.1 Směnitel A je vlastníkem:
1.1.1. bytové jednotky č. 4 , nacházející se v budově č.p.45, par.č. 319, katastrální území Běchovice, obec Písek, o výměrové ploše 78,5 m2, jednotlivým místnostem přísluší tyto výměrové plochy:
- kuchyň o výměře 12 m2
- pokoj o výměře 24 m2
- pokoj o výměře 28 m2
- předsíň o výměře 5 m2
- koupelna o výměře 7 m2
- záchod o výměře 2,5 m2
a s tímto vybavením kuchyňská linka, sporák, dřez, vana, umyvadlo, WC mísa s nádrží, mísící baterie 2 ks, topná tělesa, listovní schránka; příslušenstvím bytu je sklepní kóje č. 8 o výměře 6 m2;
1.1.2. odpovídajícího ideálního spoluvlastnického podílu na společných částech budovy č.p. 45 nacházející se na pozemku parc. č., 319 o výměře 149m2, v k.ú. Běchovice, obec Praha, v rozsahu 785/3245; základy včetně izolací, nosné svislé a vodorovné konstrukce, vnější omítky, plášť, střecha, střešní krytina, vnější zámečnické a klempířské konstrukce, výtah včetně strojovny, výtahové šachty a výtahových dveří, schodiště, chodby, sauna, komora, sklad, WC, dveře a okna u společných částí, hlavní rozvody instalací studené a teplé vody, kanalizace, silno a slaboproudé elektroinstalace, plynu, vše s výjimkou částí patřících k některé z vymezených jednotek, a hromosvody.
1.1.3. odpovídajícího ideálního spoluvlastnického podílu na pozemku parc. č., 319 o výměře 149m2, v k.ú. Běchovice 601527, obec Praha, v rozsahu 785/3245.
(Dále také „Předmět směny A“)
1.2 Směnitel B je vlastníkem:
1.2.1. budovy č.p. 78 nacházející se na pozemku parc. č. 545, o výměře 3500 m2, a pozemku parc. č. 789, vše v k.ú. Kunratice, obec Praha
(Dále také „Předmět směny B“)
1.3 Smluvní strany zamýšlejí směnit Předmět směny A za Předmět směny B za podmínek stanovených v této smlouvě.
2. PŘEDMĚT SMLOUVY
2.1 Směnitel A se zavazuje předat Předmět směny A Směniteli B a Směnitel B přijímá Předmět směny A do svého výlučného vlastnictví.
2.2 Směnitel B se zavazuje předat Předmět směny B Směniteli A a Směnitel A přijímá Předmět směny B do svého výlučného vlastnictví
2.3 Na Měnitele B přecházejí účinností této smlouvy práva a závazky v souvislosti s uzavřením smlouvy o správě domu, kterou zajišťuje ABC Servis s.r.o., IČ 6418128, se sídlem Strakonická 14, Písek, podrobnosti o správě domu obsahuje smlouva o správě nemovitosti.
3. ZÁVĚREČNÁ USTANOVENÍ
3.1. Součástí této smlouvy je příloha č. 1. , která obsahují půdorys všech podlaží včetně schémat, určující polohu jednotek a společných částí domu, s údaji o podlahových plochách jednotek a společných částí domu.
3.2. Tato smlouva, jakož i práva a povinnosti vzniklé na základě této smlouvy nebo v souvislosti s ní, se řídí zákonem č. 40/1964 Sb., občanský zákoník ve znění pozdějších předpisů a souvisejícími předpisy.

To snad nemyslíte vážně, takovou smlouvu vůbec nejde vložit do katastru. A kam zmizel pozemek parc.č. 545, ten se nesměňuje? Chápu, že se snažíte pomoci lidem, kteří se v právu nevyznají, ale takto je pouze dostanete do nekonečných problémů s vlastnictvím.
