smlouvu o budoucí smlouvě kupní
uzavřenou dle § 50a násl. zákona č. 40/1964 Sb. v platném znění, občanský zákoník.
1. ÚVODNÍ PROHLÁŠENÍ
1.1 Budoucí Prodávající bude výlučným vlastníkem pozemku parc. č. 54, v k.ú. Kotěhulky, obec Karviná (dále také „Věc“) za základě již uzavřené smlouvy o převodu nemovitosti se společnosti AAA s.r.o. K dni uzavření této smlouvy je Katastrálním úřadem v Karviné vedeno řízení V-4565/2004, jehož předmětem je vklad vlastnického práva budoucího prodávajícího k Věci do katastru nemovitostí.
2. PŘEDMĚT SMLOUVY
2.1 Smluvní strany se dohodly, že do 10 dnů od vkladu budoucího prodávajícího k Věci do katastru nemovitostí uzavřou kupní smlouvu, na základě které bude Budoucí Prodávající povinen Věc Budoucímu Kupujícímu předat a Budoucí Kupující bude povinen Věc převzít a přijmout do svého vlastnictví.
3. KUPNÍ CENA
3.1 Smluvní strany se dohodly, že kupní cena za Věc bude činit 110.000,- Kč (slovy: sto deset tisíc korun českých).
4. ZÁVĚREČNÁ USTANOVENÍ
4.1. Tato smlouva, jakož i práva a povinnosti vzniklé na základě této smlouvy nebo v souvislosti s ní, se řídí zákonem č. 40/1964 Sb., občanský zákoník ve znění pozdějších předpisů a souvisejícími předpisy.

Chci se zpetat,jestli je nutné nejprve sepsat smlouvu o smlouvě budoucí,když máme vážný zájem o koupi nemovistosti. Nestačila by pouze kupní smlouva, samozřejmě perfektně vypracovaná. Dvě smlouvy budou asi i dražší než jedna, nebo se mýlím?Děkuji

Dobrý den,
Smlouva o smlouvě budoucí Vám zaručí, že prodávající nebude nemovitost nabízet nikomu jinému, nedejbože aby ji prodal někomu kdo dřív přinese peníze. Dají se v ní ukotvit podmínky pro lhůtu splatnosti, lhůtu uvolnění bytu a jiné. Samozdřejmě dvě smlouvy jsou dražší než jedna. Pokud, ale kupujete tento byt přes realitní kancelář, je toto zpravidla zdarma jako součást Vámi zaplacené provize (rezervačního poplatku). Jestliže majitele oné nemovitosti znáte a důvěřujete mu, můžete samozdřejmě sepsat kupní smlouvu ihned. Přeji hodně štěstí.

Jednáme o stavení, které je majetkem mých rodičů. Moji čtyři sourozenci i rodiče souhlasí s tím, aby mi rodiče statek darovali, jelikož zde bydlím a podnikám na základě nájemní smlouvy a nikdo jiný nemá o nemovitost zájem. Do darovací smouvy memohu ukotvit nějaké vyplácení sourozenců. Procházím sice složitějším soudním řízením s bývalým společníkem, kde pravděpodobně za delší čas vysoudím zpět nějaké peníze, ale není to jisté. I to je důvod, proč zatím nechceme darovací smlouvu sepsat, nechci být vlastníkem, dokud nebubu mít pokoj od soudů. Je možné sepsat s rodiči smlouvu o budoucí darovací smlouvě? Ač to zní tvrdě, jednalo by se vyloženě o ochranu v případě úmrtí rodičů. Bude mít taková smlouva v uvedeném případě nějakou váhu? Mají mi sourozenci případně sepsat nějaké vyjádření o tom, že si podíly nenárokují? Děkuji za radu.

cit.:”že do 10 dnů od vkladu budoucího prodávajícího k Věci” domnívám se, že mělo být “od vkladu vlastnického práva budoucího prodávajícího” To jako připomínka redakci která presentuje VZORY, v nichž by neměly být věcné chyby. Rovněž vazba lhůty do deseti dnů od vkladu je pochybná, v praxi by mohl lehce vzniknut spor o dodržení takové lhůty, neboť není zřejmé, co autor považuje za vklad (snad doručení smlouvy s vyznačenou doložkou poslednímu účastníkovi řízení?). Ze zákona se “vkladem” rozumí zápis do katastrálních operátů, o jejichž okmžiku provedení s účastník dozví se značným zpožděním, mnohdy delším, než je uvedená desetidenní lhůta. Dobrá právní služba musí být vždy založena na preciznosti. Byť služba veřejnosti přístupná zdarma.

Dobrý den, jsem studentka vysoké školy a píšu práci “smlouva o smlouvě budoucí” . Už ji mam hotovou, ale chybí mi tam jeden bod - volba sudiště a rozhodčí právo. Jeden subjekt je totiž zahraniční osoba. Vím, že doložka by měla znít …v případě sporu ….se bude řídit dle českého obch. zák ….? Nevím přesně, mohli byste mi prosím poradit? Děkuji moc.

Dobrý den,při koupi nemovitosti je mimo jiné nutné prohlášení že nemovitost není zatížěna vadami(nájem,věcné břemeno…) a smluvní pokuta alespoň v hodnotě poloviny kupní ceny.Má osobní zkušenost (na vlastní kůži) Může se Vám stát že koupíte nemovitost,máte prohlášení o nezávadnosti a potom někdo vytáhne nájemní smlouvu s datumem starším něžje ten na Vaší smlouvě aVy jste sice majitelem,ale užívá ten kdo má najemní smlouvu např.na 100 let.Nenaděláte nic, můžete se soudit s tím kdo Vás podvedl a to je nekonečné.
Největší bordel je to že nájemní smlouva nemusí být ověřená a dá se tedy sepsat zpětně.Proč to tak jde na to by nám tady mohl někdo odpovědět.

bydlím u své babičky v nájemním městském bytě, jsem tam trvale přihlášen k pobytu cca 3 roky.Město babičce byt prodalo řádnou kupní smlouvou.Babička mi chce obratem byt převést darovací smlouvou (věkové riziko).Může takto učinit, neplatí zde pětiletá lhůta s nakládáním s nemovitostí?

Pro Kláru. odstoupit půjde podle mě opravdu těžko. Je potřeba si vždy rozmyslet co děláte než to podepíšete.

K Renátě: Smlouvu o budoucí darovací smlouvě uzavřít lze.
K Kláře T: Zkuste to uhrát na omyl. nebo jinak smlouvu zneplatnit. Jinak pokud jste si možnost odstoupení od smlouvy neujednali, není to možné pokud se na tom nedohodnete.

Dobrý den,chci se jen zeptat,měl jsem zájem o koupi větší garáže(250000,-Kč),s prodávajícím jsme se oboustraně domluvili-ale (ústně)! o ceně.Vyřídil jsem si úvěr(!),prodejce mě ještě tvrdil,že ještě vyřídí odhad a prodeji nic nebrání.Když mělo dojít kprodeji,řekl mi,že si to rozmyslel-že to neprodá!Zjistil jsem že dál inzeruje tuto nemovitost-ovšem za vyšší nabídku.Je možnost nějaké obrany proti tomuto jednání-když já mám úvěr(a vlastně na nic)?Děkuji za odpověď.Roman

Dobrý den,
chceme koupit nemovitost, kde není dosud vystěhována l osoba. Máme v úmyslu sepsat smlouvu o budoucí smlouvě, kde by byl uveden termín vyklizení objektu s tím, že teprve poté by byla sepsána smlouva a proveden zápis do katastru. Prodávající chce složit po tento termín bankovní jistinu, ve výši kupní smlouvy. Je to obvyklé? Pokud by se prodej protáhl, jdou z takto uložených peněz úroky? Jaká by mohla být smluvní pokuta, pokud prodávající některou z dohodnutých věcí v předkupní smlouvě nesplní? A jaké se obvykle dávají podmínky pro možnost odstoupení od smlouvy, pokud prodávající neplní dohody vyplývající z předkupní smlouvy. Musím dát souhlas s převodem bankovní jistiny prodávajícímu, nebo se toto děje automaticky po splnění dohodnutých podmínek. Jakým způsobem ošetřit, aby osoba v domě neměla nájemní smlouvu a nevymáhala po mě později její plnění.

Dobrý den, prosím o vysvětlení. Městská realitní kancelář předává byty do vlastnictví podle ustanovení § 22 odst.(1) zákona č. 72/1994 Sb., ve znění pozdějších předpisů, v souladu s § 43 a násl. Občanského zákoníku. Pokud nabídku nájemník nepřijme došesti měsíců, může být převeden jiné osobě, v souladu s § 22 odst. (2) a násl. zákona č. 72/1994 Sb. ve znění pozdějších předpisů, za podmínek stanovených v § 606 § 603 odst. 3 občanského zákoníku.
Do bytu jsem se nastěhovala s manželem v r.79.
Byl to služební byt, který se předal v r.2007 městu a ten je teď prodává. Já jsem se však v r. 2002 rozvedla.V bytě bydlím jen já a o bývalém manželovi nevím kde se nachází.Předpokládám, že nebude reagovat na návrh kupní smlouvy do šesti měsíců. Po rozvodu nemáme soudní vyrovnání, tak bych chtěla vědět jestli mám nárok na předkupní právo a jestli by mě měli nabídnout kupní smlouvu. Řekli mně, že jsem jen podnájemník a nemám na to nárok. Ale přece jsem o právní nárok na byt nepřišla, když není soudní vyrovnání. Děkuji za pomoc.

Dobrý den, prodávám byt a kupuji jiný. Můj byt bude volný od 1.12.2008, ale kupující bude mít peníze až v lednu(bere si úvěr). Mám chtít sepsat smlouvu o smlouvě budoucí? Když kupci nedopadne úvěr, jaký to má pro mě dopad, když bude sepsaná budoucí smlouva? Co má obsahovat smlouva o smlouvě budoucí? Smlouva o koupi bude sepsaná až v lednu při předání hotovosti? Mám trvat na záloze? Poraďte, jak se mám krýt, abych nepřišla o byt současný i budocí.děkuji za radu.

Dobrý den,včera jsem dostala smlouvu o smlouvě budoucí,prodávám rod.dum,jedna věta se mi ve předk.smlouvě nezdá, prosím o odpověd.Jednotlivé části kupní ceny celkové výši..0000111 budou prostrednictvím peněžních ústavů uhrazeny prodávající na její ban. účet č.00 a to nejpozději do 60 dnů od vkladu vlastnického práva do katastru nemovitostí. Nevím ,zdali je to tak správné,proc by měl proběhnout nejdříve vklad nemovitosti do katastru vlastnictví, jak já budu chráněná v případě,problemu ,může se stat cokoli, prosím poradte, jak se zachovat a jestli se to dá i pro stranu kupujicí nějak ošetřit. Dobrý den,
mám smlouvu o smlouvě budoucí v níž je stanoveno, že kupující (druhá strana) do jednoho roku po nabytí právní moci kolaudačního rozhodnutí bude s prodávajícím ( se mnou) sepsána smlouva o prodeji a vyplacena ve smlouvě definovaná částka. Dle mnou zjištěných informací je již po tomto termínu. Zajímalo by mne, zda-li je možné provést výpověď této smlouvy a žádat o odstranění stavby? Žádost o vyplacení mnou podána nebyla, pouze jsem na skutečnost blížícího se termínu upozornil ústně. Děkuji za odpověď

Mám smlouvu o smlouvě budoucí sepsanou 15.10.20O9. Kupní smlouva měla být sepsána1.3.2010. Kupující smlouvu nepodepsal,navíc domek zdevastoval a rozkradl. Na moje doporučené psaní nereaguje,taktéž na telefony. Vypadá to na nový Chánov !Jak dál?

Pokud se k němu přistěhuji a náhlasím trvale, mám nárok v bytě zůstat, pokud by přítel zemřel nebo by měla právo užívat byt také jeho dcera, která s ním nebydlí ve společné domácnosti?

Dobrý den, zdědil jsem nemovitost na jejímž pozemku je studna, asi po roce se přihlásil soused, že má smlouvu o smlouvě budoucí na užívání mojí studny sepsanou s dřívějším majitelem (smlova byla sepsána z důvodu stavby domu souseda a bez vody by mu nebylo vydáno stavební povolení), že chce začít kopat. Mohu mu tuto činost zakázat, i když má smlouvu o smlouvě budoucí z bývalým majitelem ? Na katastru žádné věcné břemeno na studnu zatím není zaznamenáno. Věcné břemeno by vzniklo sepsáním řádné smlouvy.
